What is National Insurance card alongside Inland Revenue letter? I have the NI Card but what is a revenue letter and from where I can get it?

I'm not sure what you mean, but my guess is you're asking with regard to which document you'd require as proof of id? In any case, the NI card is issued by the inland revenue dept. (formally known as HM Revenue and customs) which also sends you (from time to time) letters reminding you to pay tax, etc. The letter that you get from this dept concerning NI matters is for some reason, sometimes not accepted by banks as proof of address. But other correspondence from the same dept often is. Hope this answers your question!

Ok, so when Inland Revenue and Customs take tax and NIC from me for my business, does the bank account have to be in my name? Because at the moment the business bank account is in my partners name but the business is registered in my name. Anyone help? Thanks!

They send you a tax bill and you send them a cheque. NI should be on Direct Debit. You need an Accountant, as these Qs are basic. UK

The Inland Revenue dont have any recollection of me since i joined my company last November?

This company have not been paying landlords either and were subject to a winding up petition last week. So when i called the inland revenue and found out that they have no recollection of me, should i be worried that my company have not been paying the tax fo me. Now i know that if i keep all my payslips that is proof of what I have payed but i think my company is going down the pan.

This happened to me over 30 years ago, because i had my last wage slip on me to prove that i had been paying tax although my P45 said i hadn't the Inland Revenue gave me the benefit of the doubt and didn't make me repay the tax owed. Good Luck.

Can you get Inland Revenue to change their mind on a charge?

If the Inland Revenue comes up with the charges of penalty and interest charges out of the blue. The charge is 3 years old and partly their fault as they did not notify my friend till now. They are threatening taking my friend to court for not paying interest charges. What should my friend do?

This depends largely on the sort of charge we are talking about. If it is a fixed penalty, perhaps for a late return, then the charges are fixed in law and aside from them being capped to a maximum level, there is not a great scope for negotiation. For example, to get a penalty waived for a late Self Assessment Tax Return, you have a "reasonable excuse". What is reasonable to you is not necessarily reasonable to HMRC. Being on holiday is a poor excuse - you should have sent in before you left; being in a coma or otherwise incapacitated is reasonable (extreme examples yes, but you get the picture). If we're talking about an investigation, then a penalty can ONLY be charged for negligent or fraudulent conduct. That would mean that your friend knew that what was going on, but decided not to tell HMRC about it (negligence), or deliberately set out with the intention on not paying the amount due (fraud). You say that it is partly HMRC's fault, so the inference is that your friend accepts some of the responsibility him/herself. In that case, HMRC will want some level of penalty as a deterrent for those actions (otherwise everybody would do it). The level of the penalty is though open for negotiation, and the figure HMRC suggest he/she should pay isn't necessarily the final figure. The original charge that was due, and the interest associated with it, are related to the amount the law says is due. I assume that you have checked that these figures are right. If not, you should do that first - don't assume that HMRC can add up or have interpreted the law correctly! Even considering what I have said above, enquiry settlements etc are negotiable, and your friend may be able to agree with them a lesser amount that they are asking for, if that can be justified (including if there is a problem with being able to afford to pay it). It will depend on the circumstances. Paying a decent accountant to do all this for him/her could save them money or cost even more - it is a judgement call.

Can the inland revenue demand back overpaid pension credit?

I know someone who has told the Inland Revenue they think they are being paid too much Pension Credit and have given in all their income details but they have been told it is correct. What if the IR suddenly decide they have made the wrong calculation, can they demand the money back? If so, how would they expect to be repaid? Do they have any powers to stop their pension?

yes they can ask for the money back but would deduct it from any future payments at a reasonable rate

They would give you advise on how to fill in the various forms etc. Also if you file you tax return by 30/9 they will calculate it for you!.

1p Any income is, in theory, subject to taxation. A Limited company has to be registered. Otherwise it doesn't exist. I suspect you are a sole trader (Yourself T/A Yorcompany)

They do! If you go here: http://www.hmrc.gov.uk/newemployers/ and click 'Register as an employer', they will send you an Employer pack which includes a CD Rom which has PAYE calculators, payroll info & loads of other information as well. You can also order paper copies of anything you need to. Good luck!
